1. Introduction

Welcome to QardHasana. These Terms of Service ("Terms") govern your use of our website, gift widget, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy.

2. User Agreements

2.1 For Givers

As a Giver, you agree that your gift is a voluntary gift made out of goodwill. You acknowledge the required disclaimer: "I am giving purely out of admiration and willingness to help, not for profit." Gifts are processed through our third-party payment processor, Stripe, and are subject to their terms.

2.2 For Hosts

As a Host, you agree to use the Platform to receive donations for legitimate purposes as described in your application. You are responsible for all content you post and for complying with all applicable laws and regulations. You grant QardHasana a license to use your name and project information to promote your campaign on our Platform.

3. Platform Usage Rules

You agree not to misuse the Platform. This includes, but is not limited to:

• Engaging in any fraudulent or illegal activities.
• Misrepresenting your identity or the nature of your project.
• Harassing, abusing, or harming another person.
• Using the Platform for any purpose other than its intended use for sharia-compliant donations and lending.

4. Host Approval and Account Management

All Host applications are subject to review and approval by QardHasana. We reserve the right to approve or reject any application at our sole discretion. We also reserve the right to suspend or terminate any Host account that violates these Terms or engages in conduct we deem harmful to the community.

5. Donation Terms and Refund Policy

Gifts are non-refundable. In exceptional cases of proven fraud or technical error, QardHasana may, at its discretion, facilitate a refund. All donations are made in USD and must be within the specified range of $10 to $500.

6. Liability and Dispute Resolution

The Platform is provided "as is" without any warranties. QardHasana is not liable for any damages or losses related to your use of the services. Any disputes arising out of these Terms will be resolved through binding arbitration in accordance with the laws of the jurisdiction in which QardHasana operates.

7. Sharia Compliance

QardHasana is designed to facilitate transactions in a manner compliant with Sharia principles. This includes prohibiting interest (riba) and ensuring that funds are used for ethical purposes. While we strive to maintain compliance, we are not a religious authority. Users are encouraged to consult with their own advisors regarding Sharia compliance.

8. Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Platform after any such change constitutes your acceptance of the new Terms.
